Cases that reshaped property rights in India — and that we cite in your defence
Supreme Court of India
Wg Cdr Arifur Rahman Khan v. DLF Southern Homes Pvt. Ltd.
AIR 2020 SC 1468 · Civil Appeal No. 6239 of 2019
Builder held liable for not giving possession within agreed time. Supreme Court affirmed buyers are entitled to full compensation for every month of delay under RERA, reinforcing consumer rights over developer defaults.
⚖️ Buyer Victory
Supreme Court of India
Pioneer Urban Land & Infrastructure v. Union of India
(2019) 8 SCC 416 · Writ Petition (Civil) 43 of 2019
Upheld IBC provisions treating homebuyers as financial creditors with priority in developer insolvency. Homebuyers have a seat at the creditors' committee — critical protection when builders go insolvent.
★ Constitution Bench Landmark
Supreme Court of India
Ireo Grace Realtech Pvt. Ltd. v. Abhishek Khanna & Ors.
(2021) 3 SCC 241 · Civil Appeal 5765 of 2019
Supreme Court struck down one-sided builder agreements. Forfeiture clauses that penalise buyers while exempting builders from delay liability are void for being unconscionable.
🏆 Consumer Protection Win
Supreme Court of India
Imperia Structures Ltd. v. Anil Patni & Anr.
(2020) 10 SCC 783 · Civil Appeal 3581 of 2020
Homebuyers can simultaneously pursue RERA and Consumer Protection Act remedies. The two forums are not mutually exclusive — giving buyers two parallel pathways without having to elect one over the other.
⚖️ Dual Remedy Confirmed
Supreme Court of India
M/s Emaar MGF Land Ltd. v. Aftab Singh
(2019) 12 SCC 751 · Civil Appeal 1600 of 2019
Arbitration clauses in builder allotment letters cannot oust Consumer Forum jurisdiction. Homebuyers retain full right to approach Consumer Forums regardless of what the builder contract says about mandatory arbitration.
★ Consumer Rights Protected
Supreme Court of India
Kolkata West International City Pvt. Ltd. v. Devasis Rudra
(2019) SCC OnLine SC 438 · Civil Appeal 3182 of 2019
Builder liable to refund the entire amount with interest if it fails to deliver possession in time — regardless of any penalty clause limiting the refund. Protects buyers from pre-drafted contractual caps on their claims.

Frequently Asked Questions
Common questions about property disputes and our free consultation
Is the first consultation really free? What does it cover? ▼
Yes — completely free, no hidden charges. The 30-minute consultation covers: reviewing your case facts, advising which forum is best (RERA, Consumer Forum, High Court or Supreme Court), explaining your rights and realistic timeline, and outlining cost structure if you wish to proceed. Zero obligation to engage us further.
My builder is delaying possession — what are my options? ▼
Under RERA Section 18, if the builder fails to hand over possession on the agreed date, you are entitled to: (1) a full refund with interest at the prescribed rate, or (2) monthly delay compensation if you wish to keep the flat. You can simultaneously pursue RERA and Consumer Protection Act — confirmed by the Supreme Court in Imperia Structures v. Anil Patni (2020). Our specialists assess your agreement and payment records to determine the strongest path.
Can I file a case if I am an NRI based abroad? ▼
Yes. NRI clients can appoint a Power of Attorney holder in India to represent them in all proceedings. We handle FEMA compliance, RBI permissions and repatriation paperwork. We have resolved disputes for clients in the UK, UAE, USA, Canada and Australia without them needing to travel to India for most proceedings.
How long does a RERA case typically take? ▼
RERA authorities are mandated to dispose complaints within 60 days. In practice, a straightforward builder delay case takes 4–8 months from filing to order. RERA Appellate Authority appeals may take an additional 3–6 months. Consumer Forum cases generally take 6–18 months. Supreme Court interim relief orders are often granted within weeks of filing, providing immediate relief.
What documents should I gather before the consultation? ▼
Ideally: (1) Builder-Buyer Agreement or Allotment Letter, (2) all payment receipts and demand letters, (3) agreed possession date from the contract, (4) any correspondence with the builder, (5) Sale Deed or Registry documents if registration has happened, (6) RERA project registration number. Do not worry if you do not have all of these — we advise how to obtain missing documents during the free call itself.
My sale deed has a suspicious clause — can you review it before I register? ▼
Absolutely — pre-registration due diligence catches red flags such as undisclosed encumbrances, incomplete title chains, builder lien on the property, mis-stated carpet area, and one-sided forfeiture clauses. A legal audit before registration is far less expensive than a dispute after. Our specialists deliver a written legal opinion within 48–72 hours of receiving the documents.
